    HMEC Appeal – Sign Dharma Coalition Letter to Support BAPS

    There have been recent news articles about Bochasanwasi Akshar Purushottam Swaminarayan Sanstha (BAPS) mandir construction project in New Jersey.  While we cannot comment on the legal matters, we understand that BAPS is cooperating with the relevant law enforcement agencies and the truth will eventually prevail. The attack on BAPS, for caste discrimination bewildering.  We have a long history of working with BAPS and have always known it as an exemplary organization working for the upliftment of all Hindus regardless of caste, creed or race.  These attacks fit the recent pattern of characterizing American Hindus as castist in various forums.  

    As HMEC, we request all the mandirs to come together and sign the enclosed statement as members of Hindu Mandir Executives’ Conference, as a statement on equality, and expressing a unified Hindu support for BAPS.

    As practitioners of the many diverse traditions that constitute Hindu faith in North America, we stand united in valuing the life of every being. We believe that each soul is divine, in this world and beyond. Inspired by the values found in the ancient Upanishadic mantra “vasudhaiva kutumbakam,” that the whole world is our family, we strive for justice for all members of that family, regardless of caste, religion, race, and gender. Thus, as is true of many faith communities, Hindus are committed to addressing instances of injustice whenever and wherever they appear. 

    On May 11th, 2021, the New York Times outlined allegations against the Bochasanwasi Akshar Purushottam Swaminarayan Sanstha (BAPS) regarding its temple construction project in Robbinsville, New Jersey.  BAPS disagreed with the allegations and stated that they are cooperating fully with all relevant investigative authorities. We trust that the truth will be brought to light through the legal process.

    The allegations, however, confound our and numerous others’ experiences with BAPS as a Hindu tradition that rejects caste-based discrimination of all kinds. Those familiar with the tradition know that dismantling caste differences has been a central priority of Bhagwan Swaminarayan and the gurus of BAPS. Observing BAPS’s commitment to justice in their religious, social, and charitable work in North America over the past five decades gives us faith that they will remain committed to justice, and they deserve the basic presumption of innocence until the conclusion of the legal proceedings when all the facts emerge.

    We recognize that this is a difficult time for the American Hindu community. These unproven allegations challenge our core values, portraying them in public discourse as fact in a way that perpetuates misinformed and damaging stereotypes about Hindus and Hindu dharma. 

    Caste is not a principle that guides Hindu society. Caste is not even a Hindu concept and ideas about caste among Hindus have never been monolithic or static. This does not diminish the fact that Dalit, Bahujan, and Vanavasi communities have unjustly suffered from mistreatment, both historically and today. We recognize that we all have a role to play in overcoming all inequities and are committed to doing so.  

    As we continue to stand with marginalized members of society, we urge members of mandirs, Hindu organizations, civil society organizations, and the interfaith community to recognize the damage that an unfounded prejudice against any community does to all of us and express our commitment to allow the facts to emerge through the legal process before passing judgment or supporting those who do.

    New Jersey is the latest state to attempt to designate Swastika as a hate symbol with NJ Bill AB 174.  While this bill tries to distinguish the Nazi Hakenkreuz from the Swastika, any vilification of auspicious word Swastika is denigrating to the followers of the dharmic community.

    This is the third attempt in past few months, and second in two weeks to designate Swastika as a hate symbol through a legislation.

    Indian Americans win 8 month long battle: Chicago Anti-India Anti-CAA Resolution Defeated.

    Excited and relieved Indian Americans all over the USA celebrated the defeat of a Chicago resolution sponsored by Ms. Maria Hadden, city councilor of 49th Ward.  Called “the sugar coated cyanide pill” by Chicago Indian Americans, the resolution started off by congratulating India for its democracy and Independence Day but soon moved to vicious and denigrating clauses.

    A long drawn 8 month long battle, ensured that the Indian American community had to pull all stops to counter the apparent lies that the organization behind this maneuver, Council for Islamic Relations (CAIR) was spreading around to clueless Councilors.

    Finally efforts paid off when 26 Councilors voted against the resolution, saying we have more pressing things closer home to take care of. Only 18 voted for it, ensuring that the resolution is soundly defeated and not tabled again.

    “Instead of caring for her own 49th ward, an approximately 10 Square kilometer area Maria Hadden is spending all her time in a symbolic and non-binding resolution that is bent on scolding India, the sole democracy and refuge for persecuted peoples in that part of the world,” said Mr. Amitabh Mittal who heads the Indo US Friendship Council in Chicago.

    Indian Americans are busy contributing to the American economy as doctors and engineers and Space scientists. They are too busy to be aware of either the CAA or the fact that Progressive Left members of the Democrat City Councils are tabling these resolutions, “said Vandana Jhingan to a TV Channel that interviewed her recently.

    The resolution is called “symbolic” and “non-binding” and contains many inaccuracies based on misstated allegations by vested parties. However, it has repercussions not on India but the Indian Americans in the USA, who have suffered hate crimes recently in cities like Seattle and in California. They also face the consequence of a divided community and the prospect of a factually incorrect resolution staying in the Cities historical Records.” said Mr Bharat Barai, an Oncologist and stalwart of the Indian American Community since past 40 years in Chicago. An 8 month long fight was supported by elders like him who served as guiding spirits uplifting the volunteers.

    Independent of the volunteers, the Indian Consular General Mr. Amit Kumar also worked in his own capacity, approaching the sponsoring group of city councilors, educating them on the oft maligned and misquoted Indian laws like CAA and Article 370 and Farm Laws. 

    Sachin Tripathi made his public comments and said we may not have money on our side but we have truth. Eventually, truth did prevail as city Alderman Moore and 25 others voted against it.

    Alder Moore made a very powerful statement that sums up the situation in a very statesman like manner, “I have constituents in the Indian American community in the  28th Ward and the majority of them are not supportive [of this resolution 2020-583] Again, I think we have more than enough work in the city of Chicago, we want to talk about oppression…racism…and about issues that have impacted members of the community, but again I understand that people have the right to propose any type of legislation they wish. However unfortunately, I would not support this because I look out the window and I see young men and women who do not have jobs and I see young men and women who can barely read and those that have lost a level of hope and I don’t think they would appreciate their aldermen focusing on what’s going on 8000 miles away when I got challenges two blocks where I live.”

    Another Alder who voted Nay, also said that he would like to focus on local issues and not on issues beyond the Chicago city at this time when they were suffering severe crimes and Covid 19 issues in the city.

    It was a big win and big relief to those who followed this long drawn battle, as Chicago was the biggest city to table this insidious and motivated resolution. Unfortunately about 7 cities have passed these nefarious resolutions sneakily, behind closed doors under the quiet of the COVID 19 crisis. A big fight was put up in Seattle and St. Paul cities but these cities passed the resolution despite knowing the facts on the matter, clearly indicating political machinations. 

    It is pertinent to note that people like Varusha Khan who is a newly elected member of the Redmond City Council near Seattle, and who is also a director of Council of Islamic Relations (CAIR) has tried to ban an Indian American organization APPWW, calling it Islamophobic, after it held a conference highlighting human rights issues in Baluchistan, Sindh, and other provinces of Pakistan. Mr Tarek Fateh also spoke about the abysmal plight of Hindus in Pakistan during this conference held in August 2020 highlighting the dire need for CAA.

    While Chicago has much to celebrate today, 24th March 2020, the Indian Americans need to stay awake to such machinations as displayed by Varusha Khan and others who are targeting the Indian Americans with unceasing regularity trying to malign the name of a community largely known as a model minority in the USA.

    American Hindus Against Defamation (AHAD) an initiative of World Hindu Council of America (VHPA), has issued the following statement on NY State Senate Bill SS 6648:

    NY State Senate Bill SS 06648 sponsored by Senator Todd Kaminsky (D) 9TH SENATE DISTRICT and co-sponsored by Senators Joseph Addabbo Jr (D) 15TH SENATE DISTRICT, Alessandra Biaggi (D, WF) 34TH SENATE DISTRICT, John Brooks (D) 8TH SENATE DISTRICT, and  David Carlucci (D) 38TH SENATE DISTRICT has a stated purpose to require that the New York school children be educated regarding the meaning of swastikas and nooses as symbols of hatred and intolerance. 

    Ajay Shah, Convenor of American Hindus Against Defamation (AHAD), an initiative of World Hindu Council of America (VHPA) said that, 

    “the proposed NY State Sentate Bill SS 06648 requiring instruction regarding symbols of hate to be incorporated into the curricula for grades six through twelve perpetuate ignorance and promotes HinduPhobia in schools across New York state. AHAD pledges to work with other Hindu organizations to ensure that this legislation is modified to remove the references to Swastika.

    American Jewish Committee (AJC) working with the VHPA and other Hindu organizations in Washington, DC has produced a brochure titled, “Understanding Swastika, Use and Abuse of a sacred symbol.”  The AJC brochure quotes, the following from Declaration of the Second Hindu-Jewish Leadership Summit, held in February 2008, Jerusalem, 

    “The Svastika is an ancient and greatly auspicious symbol of the Hindu tradition. It is inscribed on Hindu temples, ritual altars, entrances, and even account books. A distorted version of this sacred symbol was misappropriated by the Third Reich in Germany, and abused as an emblem under which heinous crimes were perpetrated against humanity, particularly the Jewish people. The participants recognize that this symbol is, and has been sacred to Hindus for millennia, long before its misappropriation.” Shah said, “We believe that this brochure in itself is sufficient to remove Swastika from the purported purpose of this legislation.” 

    Swastika is considered one of the most sacred symbols by religious traditions that evolved in India (dharmic traditions), including Hindu, Jain, Buddhist and Sikh faiths.  The history of the Swastika is over 10,000 years old. It has appeared in several civilizations all throughout the world. From Greece and Rome to the Druids and Celts. Today, the Swastika is an integral part of many cultures including India and East Asian cultures that adhere to Buddhism. It has regularly been donned on Hindu homes, businesses, temples, and other objects. Hindu families gather round to place it in front of their homes for good luck and protection. 

    Unfortunately, 10,000 years of a symbol of wellbeing was desecrated by the monstrous regime of Nazi Germany, in the first half of the 20th century. Hitler perverted a symbol of goodness to fuel his agenda of hate. Utsav Chakrabarty, World Hindu Council of America Director of Advocacy and Awareness said, 

    “We acknowledge the horrid way the swastika has been misused and misinterpreted. Even though Hitler never used the word “Swastika”, and instead used the same symbol, calling it Hakenkreuz, for the past 70 years, the Swastika continues to remain a vilified and maligned symbol. This must be corrected. Instead of censoring the symbol, we must celebrate the positive  history of it. We must reclaim it from Hitler and the followers of his hateful ideology. This wrong must be righted.”

     

    To label the Swastika as a symbol of hate would be a grave insult to 1.8 billion Hindus and Buddhists around the world. It would be a grave insult to over 300,000 Hindu New Yorkers who come from diverse ethnic and racial backgrounds, and contribute immensely to the community and economy. Today’s political climate demonstrates the importance of diversity and celebrating ones’ heritage. Maligning this ancient heritage would be a step backwards in promoting interfaith harmony and would lead to increase in hate crimes and Hinduphobia.  AHAD demands that the meaning and significance of Swastika be included in the educational curriculum so that the hate crimes against Hindus are not perpetuated.

    HinduPACT Letter on Hinduphobic Redmond City Council Resolution #1534

    On Sept 1, 2020, Redmond, WA City Council Resolution 1534 sought to condemn APPWW (ALLIANCE FOR PERSECUTED PEOPLES WORLD WIDE) for taking up the cause of persecuted minorities around the world.  We believe that the sponsor of the resolution singled out APPWW because it’s key members were Hindus and they highlighted the plight of Muslim minorities such as Baloch, Ahamadis etc and other minorities such as Yazdis and Hindus in some Muslim majority countries.  HinduPACT wrote to the Redmond City Council members urging them to vote against the resolution and seeking a vote on an amended resolution that broadly condemned all hate.  Eventually, the resolution criticizing APPWW failed and amended resolution passed.

    Today, Redmond City Council is taking up Resolution #1534 “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDMOND, WASHINGTON, CONDEMNING HATE BY APPWW AND AFFIRMING REDMOND VALUES OF INCLUSION”

    Hindu Policy Research and Advocacy Collective USA (HinduPACT USA) urges the Redmond City Council members to reject this resolution because APPWW is singularly committed to defend persecuted minorities around the world:

    1. APPWW has taken up the cause of persecuted Hindu, Buddhist, Sikh, and Christian minorities in the Indian subcontinent, especially Pakistan and Afghanistan, which are Islamic countries

    2. APPWW taken up the cause of persecuted Muslim minorities, e.g., Baloch, and Ahmadis in Pakistan

    3. APPWW has taken the cause of Native Americans

    The resolution against APPWW is especially troubling because:

    1. The petitioners seek to shut down the voice of a small organization because it is run by a Hindu religious minority that seeks to speak for persecuted Muslims.

    2. It is a politically motivated Indiaphobic resolution disguised as Islamophobic resolution because APPWW chose to speak out against persecution of minorities in Pakistan

    3. A letter referenced in the resolution touting support from some organizations (https://condemnappww.wordpress.com/2020/07/28/a-public-letter-exposing-appww/) indicates that one of the members of APPWW opposed Congresswoman Illhan Omar and that makes her Islamophobic. Since when is legitimate opposition to any political candidate on any ground considered hate against any particular faith? In our democracy, we retain rights to oppose candidates we do not agree with on any ground, including issues that arise out of practice of faith such as school prayers or abortion without sprouting hate against individuals or their faith by getting signatures from dozens or organization. What is next? Is anyone running against Councilwoman Khan going to be labelled Islamophobe because they have a viewpoint that is dissimilar to hers?

    We urge the City Council members to explicitly oppose Hinduphobia and phobias against people of all faiths, in Redmond and around the world. HinduPACT USA, hopes that members of Redmond City Council and many organizations who have signed the letter against APPWW will join hands in opposing the persecution of Islamic minorities in Pakistan, Afghanistan and Kashmiri Hindus who have been victims of terrorism and are now refugees outside Kashmir.

    HinduPACT Opposes San Francisco, CA Resolution Against India’s CAA

    On July 22, 2020, San Francisco, CA City Council became the sixth US city council to pass Indiaphobic and Hinduphobic Anti-CAA Resolution condemning India for expediting citizenship to persecuted minorities in Indian Subcontinent.  HinduPACT registered a strong protest against this resolution and urged  mayor of San Francisco to veto the resolution.  Mayor did not sign this resolution, however, since the Mayor did not actively veto the legislation, it was adopted after a waiting period.

    For thousands of years, in India, religious edicts were not imposed on the population and the adherents of different religions chose their own form of faith and practices, including atheism. This openness of Dharmic thought led Zoroastrians to seek refuge when they fled the Islamic persecution in Iran. India was the only country where Jews were not persecuted in over two thousand years of presence. Christianity has existed in India almost since its inception and has flourished based on the increase in the number of its adherents.

    Prime Minister Narendra Modi, for the first time in independent India’s history, brought a law that gives citizenship and equal rights to persecuted religious minorities from countries that constitutionally treat those minorities as second class citizens.  Vice President Joe Biden and many lawmakers from the Democratic and the Republican Party have gone on record supporting similar support to those same minorities.  

     

    The San Francisco City’s resolution, claiming that the law is “discriminatory to Muslims, caste oppressed, women, indigenous peoples, and the LGBTQ community and any other efforts that render vulnerable populations anywhere to become stateless, scapegoated, and targeted for discrimination, violence and the abrogation of human rights”, is a myth perpetuated by those who want to malign Hindus, by the countries that are perpetuating terrorism in India and those who are politically opposed to the current leadership of India.  


    The Indian Citizenship Amendment Act (CAA), passed in 2019 passed by the Indian Parliament is consistent with the American values of compassion for the victims of religious persecution.  Cuban Adjustment Act (CAA) passed by the US Congress, provides a pathway to permanent residence for Cubans who were victims of communist oppression. The Lautenberg Amendment to the Jackson–Vanik amendment to the Trade Act of 1974 enacted on November 21, 1989, specifically provides refugee status in the United States for nationals from the Soviet Union and later the former Soviet Union, Ukraine, Estonia, Latvia or Lithuania who are Jews, Evangelical Christians, Ukrainian Catholics or Ukrainian Orthodox; as well as nationals of Vietnam, Laos, or Cambodia; and Jews, Christians, Baha’is and other religious minorities from Iran.

     

    Indian Citizenship Amendment Act (CAA), expresses very similar sentiments. India, the largest democracy in the world, with its tolerant Hindu ethos has stood as a beacon of hope for persecuted minorities. The CAA declares India a sanctuary country for persecuted minority refugees from their tormentors driven by extremist Islamic religious frenzy and grants them priority immigration status.  It states:

     

    “Provided that any person belonging to Hindu, Sikh, Buddhist, Jain, Parsi or Christian community from Afghanistan, Bangladesh or Pakistan, who entered into India on or before the 31st day of December, 2014 and who has been exempted by the Central Government by or under clause (c) of sub-section (2) of section 3 of the Passport (Entry into India) Act, 1920 or from the application of the provisions of the Foreigners Act, 1946 or any rule or order made thereunder, shall not be treated as an illegal migrant for the purposes of this Act.”

     

    In a statement, Democratic Congressman Ro Khanna has stated that “Because the rampant religious violence against Afghan Sikhs and Hindus poses an existential threat for them, I urge the US Embassy in Kabul to refer Sikhs and Hindus still in Afghanistan for emergency refugee protection under the USRAP and for the Department of State and Department of Homeland Security to accept this referral without objection to ensure their safety […]. There are deeply troubling reports of ties between Pakistan’s Inter-Services Intelligence and the terrorist organizations that carried out the 2018 and 2020 attacks, which warrant thorough investigation. […] As US forces complete our departure from Afghanistan, I am deeply worried about the health and safety of Sikhs, Hindus, and other religious minorities under threat of religious persecution and genocidal violence in Afghanistan.”

     

    India’s neighboring Islamic countries persecute minorities with impunity as declared state policy.  Recently, a Hindu girl was abducted from her own wedding venue in Sindh province of Pakistan, converted to Islam and forcibly married to a person she never knew. Amidst the COVID-19 crisis, Pakistan deprived Hindu and Christian minority of food, unless they converted to Islam.  A couple of months ago, a Hindu temple was ransacked in Pakistan, and the local Hindus were intimidated and forced to withdraw their complaints against four miscreants. In 2010, Asia Bibi, a Pakistani Christian had a simple argument with a coworker who then accused her of blasphemy. Without any proof, Bibi was sentenced to death. Due to immense international pressure, she was finally released in  2019.

     

    Hindus, Sikhs, Buddhists, Christians, Jews, and other minorities have been killed, forcibly converted, or driven out of their homes.  Since India’s independence, the Sikh and Hindu population in Afghanistan has dwindled from over 200,000 to fewer than a couple thousand.  The Hindu population in Bangladesh has decreased from 30% to 7%. In Pakistan, it has been reduced from 12.9% to 1.6%. 

     

    Statements by Vice President Biden and Congressman Ro Khanna are consistent with the American values of compassion for the victims of religious persecution. 

    India is the world’s largest democracy with an impeccable record of free and fair elections, and a democratic political process. In fact, it is the ONLY country in South and Southeast Asia, that has never been ruled by a military regime. To lie and describe a Democratically elected government with the world’s largest voter representation as a “government, with the alarming ideology that Hindus are racially and culturally superior to others”, shows the malafide intent of those who support this resolution. 

     

    The resolution calling the Government of India as “repressive and discriminatory actions of the BJP government and refusal to denounce violence, those inciting violence, and those officials evading their duties to keep order and peace;” is also misleading. 

     

    As a diverse country with fault lines, and challenges, India has had its share of violence and political disturbance. But, there has been no increase in such incidents against any specific community.

    This chart demonstrates the number of communal incidents, injuries, and deaths in India.  These numbers have not seen any significant changes as a percentage of the population.    

    As a country which gained independence through non-violent means, and which constitutionally guarantees freedom and equality to all its citizens, and mandates diversity and inclusion of all, India has set an example for other countries around the world on how peaceful protests and nonviolence should be used to achieve political goals.  India’s nonviolent movement inspired leaders like Martin Luther King, Jr, and Nelson Mandela.  No government can take these Hindu philosophy driven freedoms that are enshrined into the socio-cultural DNA of India.

     

    San Francisco, as a sister city of Bangalore, should respect the sovereignty of India and the democratic values of the largest democracy in the world, which has faced the external threats in the form of terrorism and destabilization by the intelligence agencies of its neighbors.  The speeches during the anti-CAA protests explicitly called for the division of India and cutting off the North-Eastern part of India from the rest of the country.  Pakistan’s stated attempts to snatch the state of Kashmir, and recent attempts by China to grab lands in Ladakh and Arunachal Pradesh, India is legitimately sensitive to foreign intervention to alter its territorial integrity.  This resolution is driven by those who have vested interest in breaking democratic India and converting it to a theocratic state and a one-party ruled state.

    HinduPACT has issued a point-by-point rebuttal to the Hinduphobic resolution being proposed at the Chicago City Council.  Not only is this proposal misleading but it is part of a larger conspiracy to deprive Hindu refugees that are persecuted in their own countries from seeking refuge in India, putting their lives in a grave danger.

    A RESOLUTION REAFFIRMING THE CITY OF CHICAGO AS A WELCOMING AND INCLUSIVE CITY,

    EXPRESSING THE CITY COUNCIL’S SOLIDARITY WITH CHICAGO’S SOUTH ASIAN COMMUNITY REGARDLESS OF RELIGION AND CASTE, 

    HONORING INDIA’S 74TH INDEPENDENCE DAY,

    AND URGING THE GOVERNMENT OF INDIA TO CONDEMN VIOLENCE IN THE NAME OF ANY FAITH WHILE UPHOLDING THE DEMOCRATIC PRINCIPLES AND SECULAR PROVISIONS OF THE INDIAN CONSTITUTION

    1. WHEREAS, recognizing that the City of Chicago is a sanctuary city, welcomes all regardless of their background; and
    2. WHEREAS, the Chicago City Council expresses solidarity with Chicago’s South Asian community regardless of religion and caste; and 
    3. WHEREAS, India will celebrate its 74th Independence Day on August 15, 2020, is the world’s largest democracy, and has long shared a unique and important relationship with the United States in promoting common democratic values and human rights; and
    4. WHEREAS, India is the birthplace of four major world religions, including Buddhism, Hinduism, Jainism, and Sikhism, is home to the world’s second-largest Muslim population, and has historic Christian, Jewish, and Zoroastrian populations, with three of India’s 29 states having a majority Christian population; and

    The faiths born in India are collectively described as “Sanatana Dharma,” or “dharmic traditions.” For thousands of years, in India, the religious edicts were not imposed on the population and the adherents were allowed to choose their own form of faith and practices, including atheism. This openness of dharmic thought, led Zoroastrians to seek refuge when they fled the Islamic persecution in Iran. India was the only country where Jews were not persecuted in over two thousand years of presence. Christianity has existed in India almost since its inception and has flourished based on the increase in the number of its adherents.  

    1. WHEREAS, India’s Constitution mandates a secular state that upholds the rights of all citizens to the freedoms of religion, expression, and speech and to equal treatment before the law; and
    1. WHEREAS, President Trump’s bigoted policies within the U.S. including discriminating on religious grounds, targeting vulnerable communities, stripping citizenship, fabricating crises, and stoking hatred, have been mirrored by Indian Prime Minister Narendra Modi, his Hindu extremist Bharatiya Janata Party (BJP) government, and their alarming ideology that Hindus are racially and culturally superior to others; and

    Prime Minister Narendra Modi, for the first time in independent India’s history, brought  a law that gives citizenship and equal rights to persecuted religious minorities from countries that constitutionally treat those minorities as second class citizens.  Vice President Joe Biden and many lawmakers from the Democratic and the Republican Party have gone on record supporting similar support to those same minorities.  


    1. WHEREAS, across the country, there has been a surge in the number of mob lynchings of minorities, mostly Muslims, Dalits and Christians, under Prime Minister  Modi’s leadership; and

    This chart demonstrates the number of communal incidents, injuries and deaths in India.  These numbers have not seen any significant changes as a percentage of population.  While every life is important, the preamble to the resolution as written is factually incorrect


    1. WHEREAS, the Indian parliament under the leadership of the BJP government and Prime Minister Modi passed the inherently discriminatory Citizenship Amendment Act (CAA), which actively creates an unconstitutional, religion-based criteria to grant citizenship to select immigrants – the first instance of religion being used as a criterion for Indian citizenship; and

    Indian Constitutional Amendment Act (CAA), passed in 2019 passed by the Indian Parliament is consistent with the American values of compassion for the victims of religious persecution.  Cuban Adjustment Act (CAA) passed by the US Congress, provides a pathway to permanent residence for Cubans who were victims of communist oppression. The Lautenberg Amendment to the Jackson–Vanik amendment to the Trade Act of 1974. Enacted on November 21, 1989, specifically provides refugee status in the United States for nationals from the Soviet Union and later the former Soviet Union, Ukraine, Estonia, Latvia or Lithuania who are Jews, Evangelical Christians, Ukrainian Catholics or Ukrainian Orthodox; as well as nationals of Vietnam, Laos, or Cambodia; and Jews, Christians, Baha’is and other religious minorities from Iran.

    Indian Constitutional Amendment Act (CAA), expresses very similar sentiments. India, the largest democracy in the world, with its tolerant Hindu ethos has stood as a beacon of hope for persecuted minorities. The CAA declares India a sanctuary country for persecuted minority refugees from their tormentors driven by extremist Islamic religious frenzy and grants them priority immigration status.  It states:

    “Provided that any person belonging to Hindu, Sikh, Buddhist, Jain, Parsi or Christian community from Afghanistan, Bangladesh or Pakistan, who entered into India on or before the 31st day of December, 2014 and who has been exempted by the Central Government by or under clause (c) of sub-section (2) of section 3 of the Passport (Entry into India) Act, 1920 or from the application of the provisions of the Foreigners Act, 1946 or any rule or order made thereunder, shall not be treated as illegal migrant for the purposes of this Act.”


    1. WHEREAS, in August 2019, Prime Minister Modi’s extremist government forced nearly 33 million people in the northeastern state of Assam to prove Indian citizenship or face detention at mass prisons and detention camps that the Indian government has begun to build and fill; and

    The Indian judiciary is an independent body. The Supreme Court of India in 2013 had directed any government (irrespective of political affiliation) to pursue the National Register for Citizens under which this provision is being requested. So it is disingenuous to blame PM Modi and slandering him with the term “extremist”. 


    1. WHEREAS, nearly two million people were left off the state’s citizenship rolls and a nationwide expansion of this policy could strip hundreds of millions of people (disproportionately Muslim, oppressed castes, women, indigenous groups known collectively as Adivasi, and LGBTQ+ communities) of their citizenship rights creating stateless individuals with no option to be re-naturalized; and

    This is a red herring.  On 6 September 2018, with full support of the Solicitor General of India, representing the Government of India, a 5-judge constitutional bench of Supreme Court of India invalidated part of Section 377 of the Indian Penal Code, making homosexuality legal in India.[4] In striking down the colonial-era law that made gay sex punishable by up to 10 years in prison, one judge said the landmark decision would “pave the way for a better future.” [Ref: Time Magazine

    Modi brought Transgender protection rights act in 2019.  The ruling party, insinuated as homophobic in this resolution supported the decriminalization, Bharatiya Janata Party senior leader Arun Jaitley stated in February 2014 that he supported decriminalisation of homosexuality. On 13 January 2015, BJP spokesperson Shaina NC, appearing on NDTV, stated, “We BJP are for decriminalising homosexuality. That is the progressive way forward.” [Ref: Mint]  The text of NRC in Assam makes no mention of LGBTQ, or any of the population segments mentioned in the above preamble statement.  The Indian Supreme Court mandated NRC in the Indian state of Assam was a result of decades old struggle and legal remedies sought by the people of the state of Assam, who were being rendered minorities in their state by the onslaught of illegal Bangladeshis, who were overwhelming the indegenous population,  This clause perpetuates the philosophy of those who seek the divide India further.


    1. WHEREAS, in April 2019, the Indian Home Minister, Amit Shah, compared undocumented individuals to “infiltrators” and “termites”, vowed a BJP government would “throw them into the Bay of Bengal,” and called to expand the citizenship law used in Assam to other states in India; and

    The Home Minister of India was referring to criminals and terrorists. Many of the infiltrators are part of transnational criminal gangs who traffic in women, especially underaged girls and children for child labor.  They also traffic in dangerous drugs, explosives and weapons that are known to have been supplied to terror organizations.  Some of these terror organizations have targeted the American consulates and citizens in the Indian subcontinent.  


    1. WHEREAS, protests in India against these policies have faced violent repression including: police fatally firing live ammunition at demonstrators and arresting thousands — tactics the Modi government and Indian Army have used gratuitously in Kashmir; police attacks against peaceful protestors at several prominent universities; and reports that police destroyed Muslim homes in several cities; and

    Kashmir has been besieged by state sponsored terrorism.  Hindus were brutally raped and killed by those who claimed their allegiance to terrorists like Osama bin Laden and the Islamic State (ISIS).  Hundreds of thousands of Hindus were brutalized and driven out of the state and rendered refugees as part of the Hindu genocide that began in 1989.  Pakistan has vowed to take Kashmir from India in any way possible.  This agenda driven statement that there were 80 civilian deaths in 2019, where 19 died during the protests where they were hurling projectiles and fire bombs at the local police, 17 killed by shelling by the Pakistani armed forces along the border, while 28 civilians were killed by terrorists who did not succumb to their dictate.


    1. WHEREAS, the government use of police to brutalize peaceful protestors violates fundamental democratic principles; and

    The Government of India allowed protests at the Shaheen Bagh protest to continue for 101 days. This protest blocked a major arterial road in the Capital of the county.  This disrupted not just daily life, but also prevented ambulances from reaching hospitals for those who were critically ill.  The protest, despite being violent at times towards ordinary citizens and law enforcement was tolerated by the government, and only ended when the COVID-19 pandemic took hold in the Capital.  Contrast this with the situation in CHAZ (Capitol Hill Autonomous Zone) in Seattle, WA, which neither blocked a major arterial road, nor did it impact a million lives, and was dismantled after 23 days. This points to the tolerance of the Government of India.


    1. WHEREAS, the Modi regime’s repressive and prejudiced policies are inconsistent with Chicago’s values as a welcoming and inclusive city that embraces South Asian communities of all castes and religions; and

    India is the world’s largest democracy with an impeccable record of free and fair elections, and a democratic political process. In fact it is the ONLY country in South and SouthEast Asia, that has never been ruled by a military regime. To describe a Democratically elected government with the world’s largest voter representation as a “regime”, shows the malafide intent of those who support this resolution.   


    1. Whereas, the United States has a deep history of individuals protesting against hate, injustice, and government action;

    As a country which gained independence through non-violent means, and which constitutionally guarantees freedom and equality to all its citizens, and mandates diversity and inclusion of all, India has set an example for other countries around the world on how peaceful protests and nonviolence should be used to achieve political goals.  India’s nonviolent movement inspired leaders like Martin Luther King, Jr and Nelson Mandela.  No government can take these Hindu philosophy driven freedoms that are enshrined into the socio-cultural DNA of India.


    1. Whereas, local, state, and federal government bodies in the United States have supported the right to peacefully protest against unjust policies;
    1. WHEREAS, the City Council recognizes that citizens of Chicago of all backgrounds have regularly peacefully protested in Chicago to condemn these developments in India; and
    1. NOW, THEREFORE, BE IT RESOLVED, the City Council condemns President Trump’s support for the repressive and discriminatory actions of Prime Minister Modi and his BJP government.  It also condemns President Trump’s refusal to denounce violence, those inciting violence, and those officials evading their duties to keep order and peace.
    1. RESOLVED, the Chicago City Council rejects violence in the name of any faith, condemns all supremacist thought, calls for an end of divisions along faith lines, and believes it is the duty of all people to oppose hatred, racism, and authoritarianism around the world.
    1. RESOLVED, the City Council go on record urging the Government of India to:
      1. Respect the human rights of all people and adhere to international human rights law,
      2. Condemn, at the highest levels, all religiously motivated violence, including violence which targets religious minorities,
      3. Prosecute anyone actively inciting violence, including violence against peaceful protestors and journalists,
      4. Uphold the Indian constitution by repealing the Citizenship Amendment Act, stopping the National Register of Citizens, and taking steps towards helping refugees by ratifying various UN treaties on refugees.
    1. RESOLVED, That the City Council go on record urging our congressional delegation to support legislation censuring the Republic of India for adopting discriminatory policies such as the National Register of Citizens and the Citizenship Amendment Act; and be it further
    1. RESOLVED, That the City Clerk be and hereby is requested to forward a suitably engrossed copy to Chicago’s Congressional Delegation on behalf of the entire City Council.

    In a statement, Democratic Congressman Ro Khanna has stated that, “Because the rampant religious violence against Afghan Sikhs and Hindus poses an existential threat for them, I urge the US Embassy in Kabul to refer Sikhs and Hindus still in Afghanistan for emergency refugee protection under the USRAP and for the Department of State and Department of Homeland Security to accept this referral without objection to ensure their safety […]. There are deeply troubling reports of ties between the Pakistan’s Inter Services Intelligence and the terrorist organizations that carried out the 2018 and 2020 attacks, which warrant thorough investigation. […] As US forces complete our departure from Afghanistan, I am deeply worried about the health and safety of Sikhs, Hindus, and other religious minorities under threat of religious persecution and genocidal violence in Afghanistan.”

    India’s neighboring Islamic countries persecute minorities with impunity.  Recently, a Hindu girl was abducted from her own wedding venue in Sindh province of Pakistan, converted to Islam and forcibly married to a person she never knew. Amidst the COVID-19 crisis, Pakistan deprived Hindu and Christian minority of food, unless they converted to Islam.  A couple of months ago, a Hindu temple was ransacked in Pakistan, and the local Hindus were intimidated and forced to withdraw their complaints against four miscreants. In 2010, Asia Bibi, a Pakistani Christian had a simple argument with a coworker who then accused her of blasphemy. Without any proof, Bibi was sentenced to death. Due to immense international pressure she was finally released in  2019.

    Hindus, Sikhs, Buddhists, Christians, Jews and other minorities have been killed, forcibly converted or driven out of their homes.  Since India’s independence, the Sikh and Hindu population in Afghanistan has dwindled from over 200,000 to fewer than a couple thousand.  The Hindu population in Bangladesh has decreased from 30% to 7%. In Pakistan, it has been reduced from 12.9% to 1.6%.

    Chicago, as a sister city of New Delhi, should respect the sovereignty of India and the democratic values of the largest democracy in the world, which has faced the external threats in the form of  terrorims and destabilization by the intelligence agencies of its neighbors.  The speeches during the anti-CAA protests explicitly called for the division of India, and cutting off the North Eastern part of India from the rest of the country.  Pakistan’s stated attempts to snatch the state of Kashmir, and recent attempts by China to grab lands in Ladakh and Arunachal Pradesh, India is legitimately sensitive to foreign intervention to alter its territorial integrity.  This resolution is driven by those who have vested interest in breaking democratic India and converting it to a theocratic state and a one-party rule state.

    In Pakistan, underage girls belonging to the minority Hindu, Christian, and Sikh communities are kidnapped and forcefully converted to Islam and forcibly married and subjected to rape. The Movement of Solidarity and Peace estimates that every year 1,000 such girls are forcibly converted to Islam. This estimate could be even higher than 1,000 as many cases remain unreported. A Forbes Policy report also estimates the number of forcibly converted girls to be around 1,000 per year. However, the Pakistan government rejected it and termed the report as “rubbish and baseless.”

    For the last decade, journalists and local organizations have pulled the curtains on the horrific acts of forced conversion, marriage, and kidnapping of young girls from the minority communities in Sindh, Pakistan. Little girls are snatched from their families and thrown into a life in which they are threatened, silenced, and tormented until they succumb to their kidnappers’ wishes: conversion to Islam and marriage. What is more shocking is the reluctance and ignorance of local and national government bodies in Pakistan to seek justice for these innocent victims.

    Whether Hindu, Muslim, Christian, Buddhist, or Sikh, we believe every child deserves a chance at discovery, love, education, and growth without the traumatic robbery of their innocence. Hence, we began the CHINGARI initiative. This initiative is focused on demanding accountability from the Pakistani government and the United States government for each of their complacency in allowing this grave issue of severe abuse of little children to slip under the rug. Three girls a day experience this hell in Pakistan. We want the screams of these innocent little girls from Sindh, Pakistan to be heard across the globe.

    World Hindu Council of America (VHPA) is one of the oldest American Hindu organizations. VHPA strongly opposes St. Paul City Council Resolution 20-712. We urge you to join Vice President Biden in showing compassion towards Hindu, Sikh, Buddhist, Jain, and Christian refugees from Pakistan and Afghanistan.

    Democratic Presidential candidate, Joe Biden issued a statement on May 15, 2020 that says, “I want to express my concern about the situation facing Sikhs and Hindus in Afghanistan, including the terrorist attack on Sikhs at the Gurdwara Har Rai Sahib in Kabul in March. Sikhs and Hindus are not outsiders living in Afghanistan. They are Afghan, and a vital part of the country’s heritage. The intense persecution these communities have faced in recent decades is an unspeakable tragedy. I vividly recall when, in the mid-1990s, the Taliban sought to make Sikhs and Hindus wear yellow to identify them as non-Muslims. The recent attack against Afghanistan’s Sikh community demonstrates once again the dangerous conditions for religious minorities. […]. I stand with the Sikh and Hindu communities in Afghanistan seeking safety for their families and the freedom to practice their faiths, and urge the Department of State to consider the request for emergency refugee protection.

    The city of St. Paul has a rich tradition of compassion for persecuted minorities. In December 2019, St. Paul City Council passed RES 19-2199, “Supporting the expansion of access to citizenship, lawful permanent residency, Deferred Action for Childhood Arrivals (DACA), asylum, and other forms of immigration status and benefits; and opposing the U.S. Citizenship and Immigration Services’ proposed fee increases, which would cause great harm to our city and substantially limit access based on wealth and disposable income.” This bill declares that the City of St. Paul is a welcoming and inclusive city that welcomes immigrant and refugees; and, that the “asylum seekers have a legal and human right to seek asylum and our domestic and international obligations require that we allow them that right.”

    As a logical extension of Mr. Biden’s support for evacuation of Afghan Hindus and Sikhs, the US must extend the “emergency refugee status” to Hindus and Sikhs of Pakistan. They face the same violent actors as their Afghan brethren and have been suffering a similar level of persecution. As a compassionate city, the City of St. Paul should join the former Vice President and the Government of India in saving these persecuted religious minorities.

    St. Paul City Council Resolution 20-712 is an attempt to blame the victims and further victimize them by creating barriers against their asylum. The proponents of this bill are driven by extremism against persecuted minorities. The real purpose of this resolution is to create hatred for Hindus and people of Indian origin residing in Minneapolis – St. Paul area. This resolution, if passed will lead to bullying of the children of Indian origin in schools and colleges and intimidate the hardworking people of Indian origin who work at the gas stations, 7/11s and motels among others.

    We urge the St. Paul City Council to not be intimidated by those who seek to create hate and divide the community and reject this anti-American, anti-democratic, Hinduphobic resolution.
